Terms and Conditions of Sale

TERMS AND CONDITIONS OF SALE

Last updated: 28/09/2026

Article 1: Purpose, scope and identification of the Seller

The products are sold by SAS LE CALVEZ MATHÉ, a simplified joint-stock company whose registered office is at 6 route de Lussac, 33570 Puisseguin, registered with the Libourne Trade and Companies Register under SIREN number 517 739 041, intra-Community VAT number FR76517739041 (hereinafter the ‘Seller’). The Seller may be contacted on 05 57 74 22 12 or through the contact form, linked here. Its business includes the sale of alcoholic beverages, particularly wine.

These terms and conditions of sale (‘Terms’) apply to all sales of products concluded with private individuals, either on the premises or remotely, through www.chateau-clarisse.com and at the estate (vineyard, winery and shop). Depending on availability and/or the Buyer's choice, products purchased may be collected immediately from the shop or delivered under the terms of Article 6.

Sales under these Terms are reserved exclusively for consumers, as defined in the preliminary article of the French Consumer Code, acting solely on their own behalf and having full legal capacity to enter into a contract. Products must be intended only for the recipient's personal use; resale to third parties is excluded.

As the Seller offers alcoholic beverages, all offers are restricted to adults under French law. In accordance with Article L.3342-1 of the French Public Health Code, which prohibits alcohol sales to persons under eighteen (18), the Buyer undertakes to be at least eighteen years old on the date of the order. Proof of identity may be requested by law to verify the identity and age of the person collecting or receiving the goods.

En primeur sales are subject to specific terms communicated to the Buyer before an order is placed.

Gift boxes and gift vouchers sold through chateau-clarisse.secretbox.fr are subject to that shop's own terms and conditions of sale.

Excessive alcohol consumption is harmful to your health. Please drink responsibly.

Article 2: Acceptance and amendments to these Terms

The Buyer declares that they have read and accepted these Terms before the sale. Placing an order therefore constitutes unconditional acceptance of these Terms without reservation.

These Terms remain applicable while available on www.chateau-clarisse.com and at the estate, 6 route de Lussac, 33570 Puisseguin.

The Seller may amend or replace these Terms. The applicable Terms are those in force at the time of sale.

If, after being replaced, earlier Terms remain accessible to the public by any means, they shall nevertheless no longer be enforceable against the Seller.

Article 3: Product orders

3.1 Formation of the sale

Under French law, the sales contract is formed when the parties agree on the goods and the price, and the offeror has received acceptance from the recipient. An order confirmation email summarising the order is sent to the Buyer.

3.2 Out-of-stock products and refusal of orders

If an ordered product is out of stock, the Seller may, with the Buyer's agreement, offer a different vintage of the same wine or an equivalent wine. In the absence of agreement, the Buyer shall be reimbursed any amounts paid within fourteen days.

The Seller is entitled to refuse any abnormal order or order placed in bad faith.

The Seller is also entitled to refuse an order from a Buyer with whom a dispute exists concerning payment for an earlier order.

Such refusals constitute a ‘legitimate reason’ within the meaning of Article L.121-11 of the French Consumer Code.

Article 4: Prices

Prices are expressed in euros and include all applicable duties and taxes of any kind.

VAT and duties specific to alcoholic products are charged at the rates in force at the time of sale. Product prices exclude carriage and delivery charges, the cost of certain packaging and other optional services expressly requested by the Buyer, which are charged in addition. These costs are communicated before the order is confirmed.

Article 5: Payment terms and retention of title

On the website, payment is made by bank card or another payment method offered at checkout. Where payment in instalments is available, it is provided by a third-party service provider under its own terms. Payment methods accepted at the estate are displayed on site.

The full order amount is charged when the order is confirmed. The Seller reserves the right to suspend order processing if payment authorisation is refused.

The Seller retains full ownership of the goods purchased until the Buyer has fulfilled all their obligations, in particular full payment of the price and, where applicable, interest. This does not prevent the risk relating to the goods from passing to the Buyer upon delivery.

Article 6: Delivery

Depending on availability and/or the Buyer's choice, purchased products may be collected immediately from the shop or delivered.

6.1 Delivery area

Delivery is available within mainland France to the address provided by the Buyer. Delivery to any other destination requires a prior request to the Seller, who will specify the applicable terms.

If the Buyer provides an incorrect or incomplete delivery address preventing delivery, the Buyer shall bear the costs of resending the products. If the Buyer does not wish the products to be resent, the product price shall be refunded less delivery expenses already incurred.

6.2 Delivery times

In accordance with Article L.111-1 of the French Consumer Code, the Buyer is informed, before the contract is concluded, of the latest date by which the Seller undertakes to deliver the goods. If no date is stated, delivery shall take place no later than thirty days after conclusion of the contract, in accordance with Article L.216-1 of the French Consumer Code.

6.3 Breakage during shipping

If the external condition of a parcel is unsatisfactory on delivery, the Buyer should open it in the carrier's presence to check the goods and record any reservations on the delivery note.

If one or more bottles are broken, the Buyer must refuse the parcel or, failing that, report the breakage to the Seller within three days of delivery, providing photographs. Upon receiving this information, the Seller shall, at the Buyer's choice, send an identical replacement parcel as soon as possible or refund the affected products.

If no breakage has occurred but the product does not correspond to the Buyer's order, Article 7 below applies.

Article 7: Right of withdrawal and product returns

7.1 Withdrawal process and refunds

In accordance with Article L.221-18 of the French Consumer Code, the Buyer has fourteen days from receipt of the products to exercise their right of withdrawal, without giving reasons or paying any penalty other than return shipping costs.

To exercise this right, the Buyer must inform the Seller of their decision before the deadline by means of an unambiguous declaration sent by email through the contact form, linked here, by post, or using the withdrawal form in the appendix. An acknowledgement of receipt is sent by email, stating the address to which the products should be returned.

The Buyer must return the products in their original packaging no later than fourteen days after communicating the decision to withdraw. The Buyer bears return shipping costs and must retain evidence of the return and the date it was sent.

The Seller shall refund all sums paid, including the original delivery charges, no later than fourteen days after being informed of the decision to withdraw. The Seller may defer reimbursement until the products have been recovered or the Buyer has supplied proof that they were sent back.

Refunds are made using the same payment method as the original transaction, unless the Buyer expressly agrees to a different method.

7.2 Exceptions to the right of withdrawal

Products must be returned complete and in their original condition. In accordance with Article L.221-23 of the French Consumer Code, the Buyer may be held liable for any reduction in value caused by handling beyond what is necessary to establish the nature and characteristics of the products, particularly where bottles have been opened.

Under the exception in Article L.221-28(3) of the French Consumer Code, the right of withdrawal does not apply to orders for products personalised or specially requested by the Buyer (special formats, personalised packaging and the like).

Under the exception in Article L.221-28(7) of the French Consumer Code, the right of withdrawal is excluded for alcoholic beverages whose delivery is deferred by more than thirty days and whose value depends on market fluctuations, particularly en primeur sales.

Article 8: Express waiver of the application of Article 1587 of the French Civil Code

Wine quality depends in part on subjective factors. The Buyer is deemed to have a good knowledge of our wines. The Buyer must check that the wines conform to the order on receipt. Without prejudice to the right of withdrawal and statutory warranties, no return will be accepted without the Seller's prior agreement.

Article 9: Statutory warranties

The Seller is bound by the statutory guarantee of conformity (Articles L.217-3 et seq. of the French Consumer Code) and the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code), under the conditions prescribed by law.

Under the statutory guarantee of conformity, the Buyer has two years from delivery of the goods to bring a claim. They may obtain conformity through repair or replacement or, failing that, a price reduction or cancellation of the sale. The Buyer is not required to prove the existence of a lack of conformity arising within twenty-four months of delivery.

Under the warranty against hidden defects, the Buyer has two years from discovery of the defect to bring a claim. They may choose cancellation of the sale or a price reduction, in accordance with Article 1644 of the French Civil Code.

The statutory guarantee of conformity applies independently of any commercial warranty that may be offered by the Seller.

If the non-conformity of one or more products is confirmed, the Seller shall, at the Buyer's choice and under the conditions prescribed by law:

  • refund the non-conforming product(s) or product(s) affected by a hidden defect to the bank account charged at the time of sale within fourteen days of receiving the affected product(s); or
  • replace the non-conforming product(s) or product(s) affected by a hidden defect. The replacement products will be sent to the Buyer at the Seller's expense and under these Terms.

Article 10: Information and complaints

Information about all products sold by the Seller complies with the requirements of applicable laws and regulations, in particular Article L.111-1 of the French Consumer Code.

Photographs, graphics, reproductions and descriptions of products and packaging offered for sale are provided for guidance only and do not bind the Seller, subject to mandatory legal provisions.

For further information, complaints or questions concerning these Terms or the products themselves, the Buyer may contact the Seller on 05 57 74 22 12 and/or by email through the contact form, linked here, providing the order number where applicable.

Article 11: Personal data

The Seller processes customers' personal data as necessary to manage orders and deliveries, customer relations and the Wine Club programme and, where consent is required and has been given, direct marketing. Processing is carried out in accordance with the General Data Protection Regulation (GDPR) and the amended French Data Protection Act of 6 January 1978.

The Buyer has the right to access, rectify, erase, restrict or object to the processing of their personal data and to data portability. These rights may be exercised through the contact form. The Buyer may also lodge a complaint with the CNIL (www.cnil.fr). Further details are provided in the website's Privacy Policy.

In accordance with Article L.223-1 of the French Consumer Code, the Buyer may register free of charge on the Bloctel telephone marketing opt-out list (www.bloctel.gouv.fr).

Article 12: Wine Club programme

Wine Club membership terms and benefits are communicated to the Buyer before joining.

Article 13: Force majeure

The Seller's performance of all or part of its obligations shall be suspended if an event of force majeure within the meaning of Article 1218 of the French Civil Code prevents or delays performance.

Such events include, without limitation, war, riots, insurrection, civil unrest, strikes of any kind, especially those affecting transport, and difficulties with the Seller's supplies.

The Seller shall inform the Buyer of such an event within seven days. If suspension continues for more than fifteen days, the Buyer may cancel the outstanding order and obtain reimbursement in accordance with the procedure set out in Article 9 of these Terms.

Article 14: Disputes, applicable law, mediation and competent courts

These Terms are governed exclusively by French law.

In the event of a dispute arising from the interpretation or performance of these Terms and their consequences, the Buyer and Seller shall endeavour to resolve it amicably. The Buyer shall submit a written complaint to the Seller by email through the contact form or by post to SAS LE CALVEZ MATHÉ, Château Clarisse, 6 route de Lussac, 33570 Puisseguin.

If no amicable agreement is reached, or the Seller has not replied within a reasonable period of one (1) month, the Buyer, as a consumer within the meaning of Article L.612-2 of the French Consumer Code, may refer the matter free of charge to the competent mediator on the list drawn up by the French Consumer Mediation Evaluation and Control Commission under Article L.615-1 of the French Consumer Code, namely:

La Société Médiation Professionnelle
www.mediateur-consommation-smp.fr
Alteritae, 5 rue Salvaing, 12000 Rodez

The Buyer must submit their mediation request within less than one year of their written complaint to the Seller.

The Buyer is free to initiate, accept or refuse mediation. Where mediation takes place, both parties remain free to accept or reject the mediator's proposed solution.

If mediation fails, disputes shall be submitted to the competent French courts designated under French procedural law.
